Summary

The Texas Court of Appeals, 10th District, has dismissed the appeal in Kristina Mizell v. Terri Anne Coggins. The dismissal is due to the appellant's failure to file a required docketing statement by the court-imposed deadlines. This action pertains to a protective order case.

What changed

The Texas Court of Appeals, 10th District, issued a memorandum opinion dismissing the appeal in Kristina Mizell v. Terri Anne Coggins (Docket No. 10-26-00045-CV). The dismissal stems from the appellant's failure to file a required docketing statement by the court's deadlines, despite being notified and warned of potential dismissal. The court also noted that while the filing fee was eventually paid, the docketing statement remained outstanding.

This ruling signifies the final disposition of the appeal, effectively upholding the original protective order from the County Court at Law No. 1 of Johnson County. For legal professionals involved in appellate cases, this serves as a reminder of the strict adherence required for procedural rules, including timely filing of docketing statements and other required documents, to avoid dismissal.

What to do next

  1. Review court rules for appellate filing requirements
  2. Ensure timely submission of all required documentation in appeals
