Marquet Antonio Flowers v. Crystal Lashun Flowers - Dismissed Case
Summary
The Court of Appeals of Georgia dismissed the direct appeal in Marquet Antonio Flowers v. Crystal Lashun Flowers due to failure to follow the mandatory discretionary appeal procedure. The case involved a divorce decree.
What changed
The Court of Appeals of Georgia has dismissed the direct appeal filed by Marquet Antonio Flowers in the case Marquet Antonio Flowers v. Crystal Lashun Flowers. The dismissal is based on the appellant's failure to adhere to the required application for discretionary appeal procedure, as mandated by OCGA § 5-6-35(a)(2) and (b) for domestic relations cases. This procedural defect means the court lacks jurisdiction to hear the direct appeal.
This ruling highlights the critical importance of following specific procedural rules for appeals in domestic relations matters in Georgia. Legal professionals representing parties in such cases must ensure compliance with the discretionary appeal process. Failure to do so, as demonstrated in this case, will result in the dismissal of the appeal, as compliance is jurisdictional.

Court of Appeals
of the State of Georgia
ATLANTA,____________________
March 03, 2026
The Court of Appeals hereby passes the following order:
A26A1311. MARQUET ANTONIO FLOWERS v. CRYSTAL LASHUN
FLOWERS.
Marquet Antonio Flowers filed this direct appeal from the trial court’s final
judgment and decree of divorce. However, appeals from “judgments or orders in
divorce, alimony, and other domestic relations cases” must be made by application for
discretionary appeal. See OCGA § 5-6-35(a)(2), (b). Compliance with the
discretionary appeals procedure is jurisdictional. Smoak v. Dep’t of Human Res., 221
Ga. App. 257, 257 (471 SE2d 60) (1996). Because the appellant here failed to follow
the requisite discretionary application procedure, we lack jurisdiction to consider this
direct appeal, which is hereby DISMISSED.
