Summary

The Court of Appeals of Georgia dismissed the appeal in Kothari v. Dunwoody Lakes Condominium Association, Inc. (Docket No. A26A1317). The dismissal was due to the appeal being duplicative of a previously filed appeal in Case No. A26A1279.

What changed

The Court of Appeals of Georgia has dismissed the appeal in Sandip S. Kothari v. Dunwoody Lakes Condominium Association, Inc., identified by Docket Number A26A1317. This dismissal is based on the finding that the instant appeal is a superfluous duplication of a pending appeal in Case No. A26A1279, which was filed after the court granted Kothari's application for discretionary review.

Parties involved in this case are directed to submit all future filings related to this matter exclusively through Case No. A26A1279. This action does not impose new compliance obligations but clarifies procedural filings for the parties involved in the ongoing appeal.

What to do next

  1. Direct all future filings for this matter to Case No. A26A1279.

Combined Opinion

Court of Appeals
of the State of Georgia

ATLANTA,____________________
March 02, 2026

The Court of Appeals hereby passes the following order:

A26A1317. SANDIP S. KOTHARI v. DUNWOODY LAKES CONDOMINIUM
ASSOCIATION, INC.

Sandip Kothari, the defendant in this civil action, filed an application for
discretionary review of the trial court’s final judgment. This Court granted the
application, and Kothari filed a notice of appeal. See Case No. A26D0119 (Oct. 17,
2025). That single filing resulted in the docketing of two identical appeals: Case No.
A26A1279 and the instant appeal, Case No. A26A1317. Because the instant appeal is
duplicative of the pending appeal in Case No. A26A1279, it is hereby DISMISSED as
superfluous. The parties are DIRECTED to submit all future filings in the appeal
under Case No. A26A1279.
