The Florida Office of Insurance Regulation issued Consent Order OIR 2026-29 approving the direct acquisition of Bonita Springs Retirement Village, Inc. (BSRV), a not-for-profit Continuing Care Retirement Community, by ACTS Acquisition and Development Company, LLC. BSRV was previously controlled by SantaFe HealthCare, Inc. ACTS Acquisition's sole member is ACTS Retirement-Life Communities, Inc. The order establishes conditions including a 30-day removal requirement for individuals deemed unacceptable under the Florida Insurance Code.
Surplus Lines Export List Adoption Following March 19 Public Hearing
The Delaware Insurance Commissioner issued a Final Order adopting the Surplus Lines Export List effective April 13, 2026, following a public hearing held March 19, 2026. The Export List identifies insurance coverages that may be placed with eligible surplus lines insurers without first conducting a diligent search among admitted carriers, consistent with 18 Del. C. ยง 1912. The Department explicitly notes that the Export List does not change existing insurer eligibility standards or compliance obligations.
Ava Lakes LLC Consent Order - CCRC Provisional Certificate of Authority
The Florida Office of Insurance Regulation issued a Consent Order granting Ava Lakes LLC a Provisional Certificate of Authority and Certificate of Authority to operate a Continuing Care Retirement Community in Boynton Beach, Palm Beach County, Florida. The CCRC will include 738 independent living units and 83 healthcare units, managed by Erickson Senior Living LLC.
Kansas PBM Reform Legislation Signed by Commissioner Schmidt
Kansas Insurance Commissioner Vicki Schmidt signed the Kansas Consumer Prescription Protection and Accountability Act into law on April 9, 2026. The legislation targets pharmacy benefit managers (PBMs) by requiring them to pass all drug rebates to health plans and banning spread pricing. It also mandates equal reimbursement for all pharmacies and grants the Department of Insurance enforcement authority. The law takes effect July 1, 2026.
Insurance Bulletin 2026-009 Clarifies Medical Malpractice Premium Rate Filing Requirements Under Amended Act
The New Mexico Superintendent of Insurance issued Bulletin 2026-009 to clarify that commercial medical professional liability insurance carriers must file updated premium rates through SERFF following amendments to the Medical Malpractice Act effective May 20, 2026. The amended law caps punitive damages at approximately $1 million for independent providers, $6 million for local hospitals, and $15 million for large hospital systems. Carriers must file rate filings or notices of no premium decreases in Case No. 2026-0088.
