Adverse Effect Wage Rate Methodology for H-2A Nonimmigrants Rule
The Department of Labor issued an interim final rule amending the methodology for determining Adverse Effect Wage Rates (AEWRs) for H-2A nonimmigrant workers. The rule will use Bureau of Labor Statistics (BLS) wage data and implement a standard adjustment factor for employer-provided housing, effective October 2, 2025.
Wagner-Peyser Act Staffing Delay for Merit Staffing Compliance
The Department of Labor's Employment and Training Administration is delaying the compliance date for the 2023 Wagner-Peyser Act Staffing Final Rule by one year. State grantees must now comply with staffing requirements by January 21, 2027, instead of January 22, 2026.
Proposed Rule: FY2026 H-2B Visa Numerical Limitation Increase
The Department of Homeland Security, in consultation with the Department of Labor, is proposing to increase the FY2026 H-2B visa numerical limitation by an additional 64,716 visas. These supplemental visas are intended for American businesses suffering or facing impending irreparable harm and will be distributed in three allocations.
