FINDINGS OF FACT The Secretary makes the following Findings of Fact: 1. Reeves operates a business with principal addresses of 1 East Erie Street, Unit 525- 2336, Chicago IL, 60611, and 3329 147th Place, Midlothian, IL, 60445. 2. From at least June 2024 through approximately November 2025, Reeves did business and represented to the public that he operated as “Kirk J. Reeves Private Bank Estate and Trust.” 3. From March 2024 through approximately November 2025, Reeves did business and has represented to the public that he operated as “KJR Private Trust Office.”

Reeves has no charter, license, certificate or any other form of authority conferred by the state of Illinois, the regulatory authority of any other state, or the authority of the federal government to engage in the business of banking. 6. Reeves has neither applied to the Department nor received approval from the Department under Section 46(c) of the Illinois Banking Act to use the word “bank” in connection with his business. 7. Reeves has no certificate, or any other form of authority conferred by the state of Illinois, the regulatory authority of any other state or the authority of the federal government to engage in the business of acting as a corporate fiduciary. 8. Reeves has neither applied to the Department nor received approval from the Department under Section 1-9 of the Corporate Fiduciary Act to use the word “trust” in the name of his business. 9. Section 46(a) of the Illinois Banking Act provides, in relevant part: No person, firm, partnership, or corporation that is not a bank shall transact business in this State in a manner which has a substantial likelihood of misleading the public by implying that the business is a bank, or shall use the word “bank”, “banker”, or “banking” in connection with the business. 10. Section 1-9 of the Corporate Fiduciary Act provides: No corporation that is not a corporate fiduciary as defined in Section 1-5.05 of this Act or a foreign corporation having received a certificate of authority under Section 4-5 of this Act shall be allowed to use the word “trust”, “trustee”, or “fiduciary” in its corporate name unless the Commissioner has approved that use after finding that the corporation will not be engaged in business as a corporate fiduciary and that the use of the word “trust”, “trustee”, or “fiduciary” by the corporation will not be misleading to the public. CONCLUSIONS OF LAW Based on the above Findings of Fact, it is CONCLUDED: 11. Reeves has violated Section 46(a) of the Illinois Banking Act by using the word “bank” in connection with his business, including by doing business as “Kirk J. Reeves Private Bank Estate and Trust.”

Reeves has violated Section 1-9 of the Corporate Fiduciary Act by using the word “trust” in the name of his business, including by doing business as “Kirk J. Reeves Private Bank Estate and Trust,” KJR Private Trust Office,” and “KJR Trust Office.” NOW THEREFORE IT IS HEREBY ORDERED: 13. Pursuant to Section 46(b) of the Illinois Banking Act, Reeves shall immediately CEASE AND DESIST from doing business as “Kirk J. Reeves Private Bank Estate and Trust” and otherwise from using the words “bank,” “banker,” or “banking” in connection with his business. 14. Pursuant to Section 5-1(b) of the Corporate Fiduciary Act, Reeves shall immediately CEASE AND DESIST from doing business as “Kirk J. Reeves Private Bank Estate and Trust,” “KJR Private Trust Office,” or “KJR Trust Office,” and otherwise from using the words “trust,” “trustee,” or “fiduciary” in the name of his business. 15. If, after this directive from the Department, Reeves persists in doing business as “Kirk J. Reeves Private Bank Estate and Trust,” “KJR Private Trust Office,” or “KJR Trust Office,” or otherwise uses the words “bank,” “banker,” or “banking” in connection with his business, or otherwise uses the words “trust,” “trustee,” or “fiduciary” in the name of his business, the Department may impose a civil penalty of up to $100,000 for each such violation of this Order pursuant to Sections 46(e) and 48(8) of the Illinois Banking Act [205 ILCS 5/46(e) and 48(8)], and Section 5-1(g) of the Corporate Fiduciary Act [205 ILCS 620/5-1(g)].
