Summary

Colorado Bill HB26-1135 proposes the "Hair Product Transparency and Safety Act," requiring warning labels on hair relaxers and synthetic hairpieces containing intentionally added carcinogens or reproductive toxicants. This act, effective July 1, 2027, aims to increase transparency for consumers regarding product ingredients.

What changed

Colorado Bill HB26-1135, titled the "Hair Product Transparency and Safety Act," mandates that manufacturers of hair relaxer and synthetic hairpiece products must affix a warning label if the product contains intentionally added carcinogens or reproductive toxicants. This requirement will take effect on July 1, 2027. The bill amends the definition of a deceptive trade practice to include violations of these labeling requirements, replacing a previous civil penalty structure.

Manufacturers selling covered hair products in Colorado must ensure compliance with the new labeling requirements by July 1, 2027. Failure to do so will be considered a deceptive trade practice, potentially leading to legal action. Compliance officers should review product formulations and labeling to ensure adherence to the new state law, particularly for products distributed within Colorado.

What to do next

  1. Review hair relaxer and synthetic hairpiece product formulations for intentionally added carcinogens or reproductive toxicants.
  2. Develop and implement compliant warning labels for products containing such substances.
  3. Ensure all covered hair products sold in Colorado meet labeling requirements by July 1, 2027.

Penalties

Violation constitutes a deceptive trade practice.
