Summary

Colorado's SB26-007 permits health facilities to allow terminally ill patients to use medical marijuana on-site. Facilities must develop guidelines for possession, usage, storage, and administration to ensure safety and compliance. The bill prohibits the state from mandating compliance as a licensing condition or if it conflicts with federal law or funding.

What changed

Colorado Bill SB26-007, concerning the 2026 Regular Session, permits health facilities to allow registered, terminally ill patients to use medical marijuana within the facility. This represents a significant shift in policy, allowing for such use under specific conditions. Health facilities that permit this use are required to develop and implement guidelines for the possession, usage, storage, and administration of medical marijuana to ensure the safety of other individuals, maintain safe facility operations, and comply with all applicable laws.

The bill explicitly prohibits the Department of Public Health and Environment from making compliance with these provisions a condition for licensing or certification. Furthermore, the department cannot require compliance if it would lead to a violation of state law, a loss of federal funding, noncompliance with Medicare or Medicaid programs, or failure to meet accreditation or licensing requirements. Health facilities are also permitted to suspend compliance if a federal entity mandates such a suspension. This bill will require healthcare providers in Colorado to review and potentially update their internal policies regarding patient substance use and facility operations.

What to do next

  1. Review SB26-007 for applicability to facility operations.
  2. Develop or update facility policies regarding medical marijuana use for terminally ill patients, including guidelines for possession, usage, storage, and administration.
  3. Ensure compliance with state and federal regulations concerning patient care and facility operations.

Concerning the use of medical marijuana by terminally ill patients in health facilities.

Recent Bill (PDF) Recent Fiscal Note (PDF) Bill Summary:

The bill ~~mandates that~~ permits a health facility to allow patients who are terminally ill and who are registered in the state's medical marijuana program to use medical marijuana within the health facility, subject to certain parameters. The bill requires ~~that~~ a health facility that allows such use to develop guidelines for ~~the use of medical marijuana~~ and impose restrictions on the possession, usage, ~~and~~ storage, and administration of medical marijuana to ensure the safety of others, safe facility operations, and compliance with other laws.

The bill prohibits the department of public health and environment (department) from requiring compliance with the bill as a condition for a health facility to obtain or renew a license or certification that it is required to carry to operate as a health facility. Additionally, the bill prohibits the department from requiring compliance if compliance would result in a violation of state law, a loss of federal funding, noncompliance with the federal medicare or medicaid programs, or noncompliance with accreditation or licensing requirements. Lastly, the bill allows a health facility to suspend compliance with the bill's provisions in the event that, and only as long as, a listed federal entity takes an action that requires the health facility to suspend its compliance with the bill.
