Summary

Colorado Bill HB26-1130 requires buildings with public restrooms to install baby diaper changing stations by July 1, 2027. Building owners must ensure stations are safe, sanitary, and clearly signed, with exceptions for historic structures or accessibility conflicts.

What changed

Colorado Bill HB26-1130 mandates the installation of baby diaper changing stations in public restrooms across various building types, effective July 1, 2027. The bill specifies requirements for placement in gender-specific, non-gendered single-stall, and non-gendered multi-stall restrooms, on each floor. Building owners are responsible for maintaining the cleanliness and functionality of these stations and must display clear signage indicating their presence and location. Exceptions are provided for certified historic structures or when installation would conflict with disability access building standards.

Building owners and managers must ensure compliance by the July 1, 2027 deadline. This includes implementing the required installations, maintaining the stations, and updating signage. Failure to comply could result in enforcement actions by local authorities. Regulated entities should review their facilities to determine the necessary modifications and ensure adherence to the new requirements, particularly concerning accessibility and historic building exemptions.

What to do next

  1. Review all public restrooms to determine compliance with new baby diaper changing station requirements.
  2. Plan and budget for the installation of baby diaper changing stations where required by July 1, 2027.
  3. Update signage to indicate the presence and location of baby diaper changing stations.

Concerning baby diaper changing stations in restrooms accessible to the public.

Recent Bill (PDF) Recent Fiscal Note (PDF) Bill Summary:

Beginning on July 1, 2027, the bill requires a building with an indoor restroom that is open to the public, including to customers or public visitors, and that does not include private offices or workspaces that are generally not open to customers or public visitors (restroom accessible to the public) to have safe, sanitary, and convenient baby diaper changing tables (baby diaper changing station) as follows:

  • At least one baby diaper changing station in each gender-specific restroom on each floor;
  • At least one baby diaper changing station in a non-gendered single-stall restroom on each floor; or
  • At least one baby diaper changing station in a non-gendered multi-stall restroom on each floor. The owner or manager of a building with a restroom accessible to the public is required to ensure that each baby diaper changing station is cleaned with the same frequency as the restroom in which it is located and maintained, repaired, and replaced as necessary to ensure safety and ease of use.

Beginning on July 1, 2027, for each restroom accessible to the public with a baby diaper changing station, the owner or manager of a building is required to display:

  • A pictogram, void of gender, at or near the restroom accessible to the public that indicates the presence of a baby diaper changing station; and
  • Signage, at or near the entrance to the building, indicating the location of each restroom accessible to the public and each baby diaper changing station in the building. Providing a baby diaper changing station in a restroom accessible to the public and providing the corresponding signage is not required if

a local building permitting entity or building inspector determines that the installation of a baby diaper changing station in a restroom accessible to the public would result in a failure to comply with applicable building standards governing the right of access for individuals with disabilities or if the building is a certified historic structure.
