Summary

The International Trade Commission has instituted an investigation into certain disposable and other closed-system electronic nicotine delivery systems (ENDS) devices and components thereof. This notice initiates the investigation, identified as Investigation No. 337-TA-1486, under Section 337 of the Tariff Act of 1930.

What changed

The International Trade Commission (ITC) has officially instituted an investigation, docketed as Investigation No. 337-TA-1486, concerning certain disposable and other closed-system electronic nicotine delivery systems (ENDS) devices and their components. This action signifies the commencement of a formal inquiry by the ITC into potential violations of U.S. trade laws related to these products.

This investigation will likely involve parties involved in the importation and manufacture of these ENDS devices. Companies involved should anticipate potential discovery requests, evidence submissions, and participation in proceedings before the ITC. While specific deadlines are not detailed in this notice, the nature of an ITC investigation implies a structured process with potential implications for market access and product availability in the U.S. for the involved parties.

What to do next

  1. Review the ITC's notice for Investigation No. 337-TA-1486.
  2. Assess potential involvement as an importer or manufacturer of subject ENDS devices.
  3. Consult legal counsel regarding potential participation or response requirements.
