The Fourth Amendment
The Fourth Amendment to the United States Constitution states:

"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

The Exclusionary Rule
The exclusionary rule is a judicially created remedy designed to deter police misconduct. It prohibits the introduction of evidence obtained in violation of a defendant's Fourth Amendment rights. Mapp v. Ohio, 367 U.S. 643, 655 (1961).
The Good Faith Exception
The good faith exception to the exclusionary rule allows the admission of evidence obtained by police who reasonably relied upon a warrant that is later found to be invalid. United States v. Leon, 468 U.S. 897 (1984).

STATEMENT OF THE CASE

The respondent, John Doe, was indicted for possession of a controlled substance with intent to distribute. The indictment followed a search of his residence, conducted pursuant to a warrant issued by a state court judge. The warrant was based on information provided by a confidential informant.

During the suppression hearing, the respondent argued that the warrant was invalid because the affidavit supporting it lacked probable cause. The respondent contended that the informant's tip was stale and unreliable. The District Court denied the motion to suppress, finding that the warrant was valid.

The Court of Appeals reversed, holding that the warrant was indeed invalid due to a lack of probable cause. The court further held that the good faith exception did not apply because the affidavit was so lacking in probable cause that the officers' reliance on the warrant was objectively unreasonable.

SUMMARY OF ARGUMENT

The Court of Appeals erred in holding that the good faith exception to the exclusionary rule does not apply in this case. The officers who executed the search warrant acted in objectively reasonable reliance on the warrant issued by a neutral and detached magistrate. The affidavit, while perhaps not meeting the highest standard of probable cause, was not so deficient as to render the officers' reliance unreasonable. Therefore, the evidence seized should not have been suppressed.

ARGUMENT

THE COURT OF APPEALS ERRED IN HOLDING THAT THE GOOD FAITH EXCEPTION DOES NOT APPLY.

The exclusionary rule is a vital safeguard of Fourth Amendment rights, but it is not without its limitations. The Supreme Court has recognized that the rule's deterrent purpose is not served by excluding evidence obtained in reasonable reliance on a warrant issued by a magistrate, even if that warrant is later found to be defective. United States v. Leon, 468 U.S. 897 (1984).

In Leon, this Court established the good faith exception to the exclusionary rule. The Court held that evidence obtained by officers acting in reasonable reliance on a facially valid search warrant issued by a magistrate should not be suppressed, even if the warrant is ultimately found to be unsupported by probable cause. Id. at 922. The Court emphasized that the purpose of the exclusionary rule is to deter police misconduct, not to penalize the errors of judges or magistrates. Id. at 916.

The Court of Appeals in this case found the warrant to be invalid due to a lack of probable cause. However, it then concluded that the good faith exception did not apply because the affidavit was "so lacking in probable cause that the officers' reliance on the warrant was objectively unreasonable." This conclusion misapplies the Leon standard.

The Leon Court outlined several circumstances in which an officer's reliance on a warrant would be objectively unreasonable:

When the magistrate is misled by information in an affidavit that the affiant knew was false or would have known was false except for his reckless disregard of the truth.
When the issuing magistrate wholly abandons his judicial role.
When the affidavit is so lacking in indicia of probable cause as to render official belief in its existence entirely unreasonable.
When a warrant is so facially deficient—for example, in failing to particularize the place to be searched or the things to be seized—that the executing officers cannot reasonably presume it to be valid.

United States v. Leon, 468 U.S. at 923.

The affidavit in this case does not fall into any of these categories. While the Court of Appeals found the informant's tip to be stale and unreliable, it did not find that the affiant knowingly or recklessly misled the magistrate. Nor did it find that the magistrate abandoned his judicial role. The warrant itself was not facially deficient in its particularity.

The crucial question is whether the affidavit was so lacking in probable cause that the officers' belief in its existence was entirely unreasonable. The affidavit contained information from a confidential informant who had provided reliable information in the past. Although the information was several months old, it was corroborated by independent police investigation. The officers presented this information to a magistrate, who determined that probable cause existed. The officers then executed the warrant in good faith.

The Court of Appeals' determination that the officers' reliance was objectively unreasonable is a subjective assessment that goes beyond the objective standard articulated in Leon. The officers relied on the judgment of a magistrate, and their reliance was reasonable under the circumstances. To hold otherwise would undermine the purpose of the good faith exception and would require officers to second-guess the decisions of magistrates, thereby impeding effective law enforcement.

The judgment of the Court of Appeals should be reversed.
