OFCCP Proposes Renewal of VEVRAA Information Collection

Email

Summary

The Department of Labor's Office of Federal Contract Compliance Programs (OFCCP) is requesting public comments on its proposal to renew the information collection for the Vietnam Era Veterans' Readjustment Assistance Act of 1974. The current approval expires April 30, 2026.

What changed

The Office of Federal Contract Compliance Programs (OFCCP) is initiating a 60-day public comment period to renew its information collection requirements under the Vietnam Era Veterans' Readjustment Assistance Act of 1974 (VEVRAA). This renewal seeks approval from the Office of Management and Budget (OMB) for the existing recordkeeping requirements, which are essential for OFCCP's enforcement of VEVRAA, a law mandating affirmative action for protected veterans in federal contracting.

Covered federal contractors, defined as those with contracts of $200,000 or more, should review the proposed information collection and submit comments by March 9, 2026. While this is a consultation, the renewal of this information collection is critical for ongoing compliance with VEVRAA's affirmative action and non-discrimination obligations. Failure to provide comments could result in the continuation of the existing information collection requirements without potential adjustments.

What to do next

  1. Review the proposed information collection for VEVRAA recordkeeping requirements.
  2. Submit comments to OFCCP by March 9, 2026.

SUMMARY:

The Department of Labor (DOL), as part of its continuing effort to reduce paperwork and respondent burden, conducts a pre-clearance

SUPPLEMENTARY INFORMATION:

I. Background

OFCCP administers and enforces the Vietnam Era Veterans' Readjustment Assistance Act of 1974, as amended (VEVRAA). Under VEVRAA,
as applied by regulation, a business with a federal contract of $200,000 or more is required to treat qualified individuals
without discrimination based on their status as a protected veteran in all employment practices. Covered contractors are also
required to take affirmative action to employ and advance in employment qualified protected veterans.

II. Desired Focus of Comments

OFCCP is soliciting comments concerning the proposed information collection. OFCCP is particularly interested in comments
that:

  • Evaluate whether the collection of information is necessary for the proper performance of the functions of the Agency, including whether the information has practical utility;
  • Evaluate the accuracy of OFCCP's estimate of the burden related to the information collection, including the validity of the methodology and assumptions used in the estimate;
  • Suggest methods to enhance the quality, utility, and clarity of the information to be collected; and • Minimize the burden of the information collection on those who are to respond, including through the use of appropriate automated, electronic, mechanical, or other technological collection techniques or other forms of information technology, e.g., permitting electronic submission of responses.

Background documents related to this information collection request are available at https://regulations.gov. Questions about the information collection requirements may be directed to the person listed in the
