Gulf Coast Council Final Rule on Federal Award Requirements
Summary
The Gulf Coast Ecosystem Restoration Council has issued a final rule amending its requirements for federal awards. This rule adopts revisions from the Office of Management and Budget's (OMB) Guidance for Federal Financial Assistance, effective October 1, 2024, superseding previous administrative requirements.
What changed
The Gulf Coast Ecosystem Restoration Council has published a final rule that supersedes its existing regulations for Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards. This amendment aligns the Council's requirements with the Office of Management and Budget's (OMB) recent revisions to its Guidance for Grants and Agreements, now known as the OMB Guidance for Federal Financial Assistance. The rule adopts these OMB revisions, with the exception of 2 CFR 200.322(c), and becomes effective on October 1, 2024.
This rule is binding on government agencies receiving federal awards administered by the Council. Compliance with the updated OMB guidance is required by the effective date. While the rule itself does not impose new penalties, failure to comply with the underlying federal award requirements could result in adverse actions from the Council or OMB. Regulated entities should review the updated 2 CFR part 200 and ensure their internal policies and procedures reflect these changes by October 1, 2024.
What to do next
- Review and adopt the updated OMB Guidance for Federal Financial Assistance (2 CFR part 200) by October 1, 2024.
- Ensure internal policies and procedures for federal award administration are updated to reflect the revised requirements.
- Note the exception for 2 CFR 200.322(c) and maintain separate compliance for that provision if applicable.
