The Antitrust Division published a notice regarding changes in the membership of the Defense Industrial Based Consortium (DIBC). This notice is filed pursuant to the National Cooperative Research and Production Act of 1993 to maintain limitations on antitrust recovery for members.

What changed

The Department of Justice's Antitrust Division has published a notice concerning the Defense Industrial Based Consortium (DIBC). This filing, made on October 14, 2025, and published on February 23, 2026, discloses changes in DIBC's membership. The purpose of these notifications, as mandated by the National Cooperative Research and Production Act of 1993, is to ensure the continued application of provisions that limit antitrust plaintiff recovery to actual damages under specified conditions for DIBC members.

This is a routine informational filing that does not impose new obligations on regulated entities. Companies listed as new members of the DIBC are part of a consortium that benefits from specific antitrust protections. Compliance officers should note this filing as an update to the regulatory landscape concerning industry consortia involved in research and production, particularly those with government ties. No immediate action is required by entities not directly involved in the DIBC's membership changes.
