Summary

New York Governor Kathy Hochul has extended the declaration of a disaster emergency due to healthcare staffing shortages, specifically citing a nursing strike. The extension, effective February 4, 2026, continues the provisions of Executive Order 56 through February 6, 2026, in Bronx, New York, and contiguous counties.

What changed

Governor Kathy Hochul of New York has issued Executive Order No. 56.4, extending the declaration of a disaster emergency originally declared on January 9, 2026. This extension, effective February 4, 2026, continues through February 6, 2026, and applies to Bronx, New York, and contiguous counties. The emergency was declared due to severe healthcare staffing shortages caused by a nursing strike, which threatens public health and safety and the ability to provide critical care.

This executive order maintains the temporary measures and suspensions outlined in Executive Order 56 to ensure the continuity of care and patient safety. Healthcare providers in the affected counties must continue to operate under the conditions stipulated by the extended emergency order. While the order aims to protect public health, it explicitly states it is not intended to provide leverage in collective bargaining. Compliance with the terms of the extended emergency order is mandatory for the duration.

What to do next

  1. Ensure continued compliance with the terms and suspensions of Executive Order 56 as extended through February 6, 2026.
  2. Monitor for any further extensions or modifications to the disaster emergency declaration.
