Summary

The Defense Logistics Agency published a notice to delete a system of records notice under the Privacy Act of 1974. This action is effective September 8, 2010, unless comments necessitate a contrary determination. The system being deleted is Employee Assistance Program Records.

What changed

The Defense Logistics Agency (DLA) has published a notice to delete a specific system of records, identified as S330.40 CAHS, which pertains to Employee Assistance Program Records. This deletion is proposed because the information is now covered under an existing Department of Health and Human Services (DHHS) system of records notice. The agency is seeking public comment on this proposed deletion, with the action set to become effective on September 8, 2010, unless comments lead to a different conclusion.

Regulated entities, particularly those within or interacting with the Department of Defense, should be aware of this change in record system inventory. While this is a deletion and not an imposition of new requirements, it signifies a consolidation of record-keeping under the Privacy Act. Compliance officers should note the effective date and the process for submitting comments if they believe this deletion would have an adverse impact or is contrary to regulatory intent.

What to do next

  1. Review DLA's inventory of Privacy Act systems of records for any potential impact.
  2. Submit comments by September 8, 2010, if the deletion of the Employee Assistance Program Records system has a contrary determination.
