Italian Competition Authority Fines Bernabei Companies for Unfair Commercial Practice
Summary
The Italian Competition Authority has fined Bernabei s.r.l. and Bernabei Liquori s.r.l. a total of €400,000 for unfair commercial practices. The companies made misleading claims and omitted key information regarding discounts on alcoholic and non-alcoholic drinks advertised on their website and app.
What changed
The Italian Competition Authority (AGCM) has imposed a €400,000 fine on Bernabei s.r.l. and Bernabei Liquori s.r.l. for engaging in unfair commercial practices. The enforcement action stems from misleading claims and the omission of crucial information concerning price reductions on alcoholic and non-alcoholic beverages sold via the www.bernabei.it website and the Bernabei app. Specifically, the Authority found that advertised 'special offers' did not reflect genuine discounts, as the prices often matched or exceeded the lowest price in the preceding 30 days. Furthermore, the 'full' or 'list' prices displayed as crossed out were found to be misleading as they were rarely, if ever, applied outside promotional periods.
This decision highlights the importance of accurate pricing and discount representations in e-commerce. Regulated entities, particularly retailers operating online platforms, must ensure that all advertised price reductions are genuine and that comparative pricing is based on actual historical prices. Failure to comply with consumer protection laws regarding pricing accuracy can result in significant financial penalties. While no specific compliance deadline is mentioned for this enforcement action, companies should review their online advertising and pricing strategies to ensure adherence to consumer protection legislation to avoid similar sanctions.
What to do next
- Review online advertising and pricing strategies for accuracy.
- Ensure all advertised discounts reflect genuine price reductions based on historical pricing.
- Verify that 'full' or 'list' prices are accurate representations of prices previously applied.

PRESS RELEASE
The companies made misleading claims and left out key information about discounts on alcoholic and non-alcoholic drinks through the website www.bernabei.it and the Bernabei app
The Italian Competition Authority has fined Bernabei s.r.l. and Bernabei Liquori s.r.l. a total of 400,000 euro for engaging in an unfair commercial practice. The Authority found that, through the website www.bernabei.it and the Bernabei app, the two companies make misleading claims and leave out key information about price reductions on alcoholic and non-alcoholic drinks advertised as being on sale. In particular, a significant number of items promoted as “special offers” are marketed unfairly. The prices advertised as “discounted” either match or exceed the lowest price applied in the previous 30 days, contrary to consumer protection legislation on the accuracy of price reductions. The Authority also found that the indication of “full” and/or “list” prices (displayed as crossed out on www.bernabei.it and the Bernabei app) is misleading and incomplete; these prices were never applied, or only to a very limited extent, outside promotional periods.
